Probate Litigation in Colorado

Probate litigation involves legal disputes concerning estates, trusts, and fiduciary responsibilities. Although our firm makes every attempt to resolve disputes using mediation or other alternative methods, some issues are resolved by going through the courts. Having experienced legal advice gives you and your family a better chance to resolve the dispute in a cost-effective manner.
We represent clients in contested probate matters, including disputes involving wills, trusts, fiduciary duties, and related proceedings.

Common Probate Litigation Issues

Probate disputes often involve questions such as:
  • Capacity and undue influence
  • Disputes over inheritance or gifts to a minor child, a disabled adult child, or a spouse
  • Challenges to the validity of a will or trust
  • Recognition of common-law marriages or issues involving divorced family members
  • Decisions to exclude a child or family member from a will

A Practical Approach to Dispute Resolution

Probate litigation often involves family disputes and can affect relationships for years to come. Our goal is to guide clients through the process while working toward practical resolutions when possible.
We work to ensure clients understand the issues involved, the alternatives that may be available, and the next appropriate steps.

Mediation Services

Mediation is a process that seeks to resolve disputes through the efforts of the parties involved and is facilitated by a trained mediator. Parties are not compelled to reach an agreement, and any party may discontinue the mediation at any time.
Mediation is sometimes ordered by the court before proceeding to a final hearing or trial. It can also be used voluntarily to explore resolution earlier in the process.
Mediation offers the parties the most control in the resolution of the dispute. In some cases, mediation allows families to resolve disputes without extended court proceedings.
Sandra Sigler is an experienced, trained mediator. She has provided mediation for Jefferson County District Court and has arbitrated cases for the Better Business Bureau, as well as many individual matters.
